Engine fraud - not the engine that was paid for.

Hey - one for the experts!
My my parents just bought a 2006 250 Rinker Fiesta Vee. It was sold with a Volvo Penta 5.7gxi 320hp engine. I had a look, and found that the engine cover serial number did not match the number on the engine itself. It turns out the engine is in fact a Volvo Penta 5.7osi-df 280hp one.
Now, the folks like the boat and it’s in fine condition. But this is of course going to court, if the dealership won’t compensate voluntarily.
That brings the question; What would be an estimated price difference between the two configurations - if any at all?
Any input would be appreciated
